This Privacy Policy explains how Bakken AI LLC ("Bakken AI," "we," "us," or "our") collects, uses, shares, and protects information in connection with our website, our software application(s) and AI agents, our SMS/text-message programs, and our marketing and automation services (collectively, the "Services"), including when our application connects to third-party platforms. It also explains your choices, your rights, and how you can request deletion of your data.

1. Who We Are

Bakken AI LLC is a North Dakota limited liability company that provides AI-powered automation, customer-communication, and marketing services to businesses. We build and operate AI agents and automated workflows that help our business clients capture leads, respond to inquiries, and communicate with their own customers across channels, including web, email, SMS, and Meta Platform products.

2. Information We Collect

We collect the following categories of information — directly from you, automatically through your use of the Services, and through permissions you grant us via third-party platforms:

Information you provide to us

  • Contact and business details such as your name, business name, email address, phone number, mailing address, and the contents of messages or forms you submit to us.
  • Billing information you provide when purchasing our Services (processed by our payment processor).
  • Content and materials you provide so our Services can operate on your behalf, such as business information, service details, message templates, and customer lists you choose to import.

Information collected automatically

  • Usage and log data, such as how the Services are accessed and used, actions taken, timestamps, and error logs.
  • Device and technical data, such as browser type, IP address, device identifiers, and referring pages.
  • Cookies and similar technologies on our website, used to operate the site and understand usage. You can control cookies through your browser settings.

Information from connected platforms (with your authorization)

  • Meta (Facebook/Instagram): where you connect a Page or account, the Page/profile information, messages and comments, and contact identifiers of people who message the connected Page, limited to the permissions you approve (see Section 6).
  • Other integrations: data from tools you connect (such as calendars, CRMs, or payment processors) as needed to deliver the Services you request.

3. How and Why We Use Information

We process information for these purposes:

  • To provide the Services — operate AI agents and automations, capture and respond to leads and messages, book appointments, manage pipelines, and run the communication workflows you configure.
  • To maintain your account and connections — so the Services keep working across sessions using the access you authorized.
  • To communicate with you — service messages, responses to your requests, and (with consent where required) marketing messages.
  • To process payments and keep records.
  • To support, maintain, secure, and improve the Services — including troubleshooting and improving the quality and accuracy of our AI agents.
  • To comply with law and enforce our terms, and to detect and prevent fraud, abuse, and security incidents.

We rely on the following legal bases where applicable: performance of our contract with you, your consent, our legitimate business interests in operating and improving the Services, and compliance with legal obligations.

We do not sell your personal information, and we do not use the content of messages or conversations processed on behalf of our clients to train general-purpose AI models. Message and conversation data is used only to operate the Services our clients have configured.

4. SMS / Text Messaging & Consent

Our SMS Program

Where you provide your phone number and expressly opt in, we (or our clients, using our platform) may send you SMS text messages such as appointment reminders, account and service notifications, lead follow-ups, and — only where you separately consent — marketing messages.

Consent is not a condition of purchase. You are never required to agree to receive marketing text messages in order to buy anything or submit a form. Marketing and non-marketing consent are requested separately, and consent checkboxes are never pre-checked.

Opt out anytime. Reply STOP to any message to unsubscribe, or HELP for help. Message and data rates may apply. Message frequency varies.

We do not share or sell your mobile opt-in or phone number to third parties or affiliates for their own marketing purposes. Mobile information is used only to deliver the messaging you consented to.

5. How We Share Information

We do not sell your personal information. We share information only as follows:

  • Service providers that help us operate the Services — such as our automation/CRM platform, AI model providers, telephony/SMS and email delivery providers, hosting and cloud storage, and payment processors — permitted to use information only to provide services to us.
  • Connected platforms such as Meta, as needed to operate the features you authorize.
  • Legal and safety — where required by law or legal process, or to protect the rights, safety, and security of Bakken AI, our users, or others.
  • Business transfers — in connection with a merger, acquisition, or sale of assets, subject to this Policy.

6. Data From Meta Platforms

When you authorize our application to connect to your Facebook or Instagram account or Page, we access and process only the data covered by the permissions you approve, which may include the list of Pages you manage, basic Page/profile information, and the messages, comments, and conversations sent to or from your connected Page or account, together with the identifiers and message content of people who contact that Page. We use this data solely to operate the messaging and automation features you have set up, in accordance with Meta's Platform Terms and Developer Policies and this Privacy Policy. You may revoke our access at any time in your Meta account settings under Business Integrations / Apps and Websites.

7. Data Retention

We retain information for as long as needed to provide the Services, maintain business records, comply with legal obligations, resolve disputes, and enforce agreements. When information is no longer needed, we delete or de-identify it. Data accessed through connected platforms is retained only as long as necessary to operate the Services you configured, or until you request deletion.

8. How to Request Deletion of Your Data

You may request deletion of the personal information we hold about you at any time. To make a request, contact:

Include enough detail for us to identify your data (for example, the connected Facebook/Instagram Page or the phone/email associated with you). We will verify and process valid requests within a reasonable time and as required by law. You may also disconnect our app in your Meta settings or reply STOP to our texts, which stops that processing going forward.

This contact address is actively monitored and kept current, as required by Meta's Developer Policies.

9. Your Privacy Rights & Choices

Depending on where you live, you may have rights to access, correct, delete, port, or restrict processing of your personal information, and to withdraw consent or opt out of certain processing or sale/sharing (we do not sell personal information). To exercise any right, contact us at nick@bakkenai.com. We will not discriminate against you for exercising these rights. You may also unsubscribe from emails via the link in any message, and from texts by replying STOP.

10. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information, including least-privilege access controls, encryption where appropriate, and secure storage of credentials and access tokens. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Children's Privacy

Our Services are intended for businesses and are not directed to children under 13 (or the minimum age in your jurisdiction). We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.

12. International Users

We operate in the United States. Information we collect may be processed and stored in the United States or other locations. By using the Services, you understand your information may be transferred to and processed in the United States.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and post the current version at this URL. Your continued use of the Services after an update means you accept the revised Policy.
